1. Agreement to Terms

By accessing or using JobLabrador ("Service"), operated by Singer Labs, a company based in Lausanne, Switzerland ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to registered users, trial users, and paying subscribers.

2. Description of Service

JobLabrador provides job matching and career services. The Service is for personal, non-commercial use only.

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use

3.2 Age Requirements

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

3.3 Right to Refuse Service

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion. We may refuse service to anyone for any reason at any time, including but not limited to:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Behavior that is harmful to other users or our staff
• Technical or security reasons
• Non-payment or disputed charges

3.4 Account Termination

We may suspend or terminate your account or cease providing you with all or part of the Services at any time for any reason, including, but not limited to, if we reasonably believe you have violated these Terms. You may also delete your account at any time through your account settings.

4. Subscription Plans and Payments

4.1 Available Plans

• Free Trial: Limited features including 1 CV upload, 1 keyword search, maximum 5 daily job matches
• Paid Subscription: Full features including multiple CV uploads, multiple keyword searches, unlimited job matches, and daily email notifications

4.2 Payment Terms

• All fees are in Swiss Francs (CHF) unless otherwise stated
• Subscription fees are billed in advance on a monthly basis
• Payments are processed securely through third-party payment providers
• All fees are non-refundable except as required by law

4.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings.

4.4 Price Changes

We reserve the right to modify our pricing. If we change the price of your subscription, we will provide you with at least 30 days' notice. Your continued use after the price change constitutes acceptance of the new price.

4.5 Refund Policy

Due to the high computational costs of AI processing and infrastructure, we do not offer refunds. However, you may cancel your subscription at any time, and you will continue to have access until the end of your current billing period.

5. User Content and Conduct

5.1 Your Content

You retain ownership of all content you upload to the Service, including:

• CVs/resumes and professional documents
• Profile information and preferences
• Feedback and communications

5.2 License to Use Your Content

By uploading content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and analyze your content solely for the purpose of providing and improving the Service. This includes:

• Processing your documents to provide job matching services
• Creating technical representations of your information
• Generating personalized job recommendations
• Improving our services and features

5.3 Third-Party Profile Data

By providing a LinkedIn profile URL, you confirm that the profile is yours and consent to us accessing the publicly available information contained in it. This includes your full professional history, such as experience, education, and skills, as found on that public profile. You are solely responsible for ensuring the accuracy of the URL provided. JobLabrador accepts no liability for any consequences arising from the submission of an incorrect or third-party profile URL. This information is processed solely to pre-fill your profile and improve your job matching experience, subject to the same license granted in Section 5.2.

If you believe that a LinkedIn profile has been incorrectly linked to an account or that information has been retrieved without proper authorization, please contact us at [email protected]. Upon verification, we will permanently remove the associated data from our systems within 72 hours.

5.4 Prohibited Uses

You may not use the Service in any way that violates applicable laws, infringes the rights of others, or interferes with the operation of the Service. Without limiting the foregoing, you expressly agree not to:

• Create an account using false, misleading, or fraudulent information
• Impersonate any person or entity, or falsely state or misrepresent your identity or affiliation
• Upload, submit, or use any CV, resume, or identity document that belongs to another person
• Create or maintain multiple accounts for the same individual
• Use the Service on behalf of another person or allow others to use your account
• Circumvent any measures designed to prevent or restrict access to the Service, including trial limitations

5.5 Consequences of Prohibited Use

If we determine, in our sole discretion, that you have engaged in any prohibited use described above—including but not limited to impersonation, identity fraud, or the use of another person's documents—we reserve the right to immediately and without notice:

• Suspend or permanently terminate your account and access to the Service
• Delete any content or data associated with your account
• Refuse any current or future use of the Service
• Report the activity to relevant law enforcement authorities where appropriate

No refund will be provided for any subscription fees paid if your account is terminated due to violation of these terms.

6. Security and Data Protection

6.1 Security Measures

We implement commercially reasonable security measures to protect the Service and your information. However, no security system is impenetrable, and we cannot guarantee the absolute security of our systems or your information. You acknowledge that you provide information at your own risk.

6.2 User Security Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• Using a strong, unique password for your account
• Enabling two-factor authentication if available
• Notifying us immediately of any unauthorized access or security breach
• All activities that occur under your account

6.3 Security Breach Disclaimer

In the event of a security breach, we will make reasonable efforts to notify affected users and take steps to address the breach. However, you acknowledge that we are not liable for any loss or damage arising from any unauthorized access to or use of the Service or your information, whether due to breach, hacking, data loss, or other security incident.

6.4 Third-Party Services

We work with third-party service providers to deliver our Services. While we select our providers carefully, we are not responsible for their security practices or any breaches that occur within their systems.

7. Intellectual Property Rights

7.1 Our Property

The Service and its original content (excluding user content), features, and functionality are and will remain the exclusive property of Singer Labs. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

7.2 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to compensate you, and you hereby assign all rights in such feedback to us.

8. Disclaimers and Limitations of Liability

8.1 Service Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 No Guarantees

We do not guarantee any specific results from using our Service. The Service is provided for informational purposes only.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SINGER LABS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, BUT IN NO EVENT MORE THAN ONE HUNDRED SWISS FRANCS (CHF 100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to defend, indemnify, and hold harmless Singer Labs, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

10. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

We comply with Swiss data protection laws and the General Data Protection Regulation (GDPR) for EU residents.

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11.2 Terms Updates

We may revise these Terms at any time. If we make material changes, we will notify you via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

12. Governing Law and Disputes

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. The courts of the Canton of Vaud, Switzerland shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Service.

12.2 Dispute Resolution

Before filing a lawsuit, you agree to try to resolve any dispute informally by contacting us at [email protected]. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Singer Labs may bring a formal proceeding.

13. Severability and Waiver

13.1 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.2 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

14. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights under these Terms without your consent.

15. Third-Party Links and Services

Our Service may contain links to third-party websites, job sources, or services that are not owned or controlled by Singer Labs. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Singer Labs shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

16. Job Listings and Third-Party Content

16.1 Nature of Job Listings

JobLabrador aggregates job listings from publicly available employment platforms. We do not create, verify, endorse, or guarantee any job listing displayed through our Service.

16.2 User Responsibility to Verify

You acknowledge and agree that it is solely your responsibility to verify the legitimacy, accuracy, and authenticity of any job listing before taking any action, including but not limited to:

• Applying for the position
• Providing personal information to potential employers
• Attending interviews or meetings
• Accepting any job offer
• Sharing sensitive documents such as identification, bank details, or references

16.3 No Guarantee of Accuracy

We make no representations or warranties regarding the accuracy, completeness, timeliness, reliability, or legitimacy of any job listing. Job postings may contain errors, be outdated, or in some cases may be fraudulent. We do not verify the identity of employers, the existence of advertised positions, or the accuracy of job descriptions, salaries, or other details.

16.4 Disclaimer of Liability

Singer Labs shall not be liable for any loss, damage, or harm arising from your reliance on or use of any job listing, including but not limited to:

• Fraudulent or scam job postings
• Inaccurate or misleading job information
• Identity theft or financial loss resulting from interactions with third-party employers
• Any direct, indirect, incidental, or consequential damages arising from job applications

16.5 Reporting Suspicious Listings

If you encounter a job listing that appears fraudulent, misleading, or suspicious, please report it to us at [email protected]. We may, at our sole discretion, remove or flag such listings, but we are under no obligation to do so.

17. Force Majeure

Singer Labs shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to:

• Acts of God, natural disasters, or severe weather conditions
• War, terrorism, riots, or civil unrest
• Government actions, sanctions, or embargoes
• Labor disputes or strikes
• Power failures or telecommunications/internet outages
• Pandemic or epidemic
• Failure of third-party services or infrastructure

In such events, Singer Labs will make reasonable efforts to notify users and resume normal service as soon as practicable.

18. Accessibility

Singer Labs is committed to making our Service accessible to all users. We strive to follow best practices for web accessibility and continuously work to improve the user experience for everyone.
